Recently, Congress passed a bipartisan change affordable Care definition of a small employer law, sending the measure on the desk of President Obama. If signed into law, the federal requirement to expand the market for small groups to medium-sized businesses in 2016 would be arrested. Let's look at what the bill is and what it means for small and medium employers. New Law Would Stop Expansion of Small Group Market

What is the bill?

Bill ( HR 1624 ), called the affordable coverage Employee Protection Act, or PACE, a provision treats the affordable care Act that amends the definition of a small employer in 2016.

as currently written, the affordable care Act defines a small employer employing 50 employees . In 2016, the definition of a small employer is changing for employers with 100 employees.

As currently written, this provision requires companies with 51 to 100 employees in the insurance small group market in 2016, where they would be faced with new requirements for coverage. For many companies, the new coverage requirements would lead to higher premiums and diet changes.

The PACE Act preserves the traditional definition of "small group", but allows states to extend it to include employers with 51 to 100 employees, if they wish.

What is the status of the bill?

The bipartisan bill passed the House September 28, 2015 and adopted by the Senate on October 1, 2015.

"This bill amends the Patient Protection and Affordable Care Act (PPACA) and the public health service to include employers with 51 to 100 employees and large employers for purposes of health insurance markets. States have the opportunity to treat these employers and small employers. Currently PPACA, employers with 51 to 100 employees of small employers, but before January 1, 2016, states have the option of treating them as large employers. (Under PPACA, health insurance offered in the small group market must meet some requirements that are not applicable to the large group market, including the obligation to cover essential health benefits.) "

Conclusion

under the current health law, midsize employers are preparing to make the necessary changes to their health insurance plans to meet the small group market reforms. If signed into law, however, PACE Act would end the federal change and allow states to establish the definition of a small group.
