If the current Senate bill Medicare adopts the House, President Obama will sign. The Senate will then vote on all changes through reconciliation. Reconciliation allow Democrats to avoid a filibuster, but this bill with a set of procedural challenges.
Republicans have two main ways to stop this process. First Republicans may raise budgetary issues and if the bill is consistent with the pay-as-you-go rules of the House. Also the bill can not contain anything "foreign" in the bill called the Byrd Rule. Under the Byrd rule, all elements of the bill must affect the budget one way or could be deleted.
Republicans can then use the amendment process to delay passage. According to Politico , Republicans can offer as many changes they want after 20 hours of debate. This could force Democrats to vote on controversial issues in the bill that would change all changes. If something is changed in the bill, it will go to the House to vote again.
So far, here are some of the key provisions:
- The Cadillac tax on generous health insurance plans will be delayed to 2018.
- It removes the deals "sweetheart" for Nebraska and Florida.
- Medicare payroll tax on the wealthy will be raised.
- The donut hole in Medicare will be reduced and subsidies for low-income people to purchase insurance will be strengthened.
If this bill as currently drafted is approved by the full House, he must make it through the reconciliation process in the Senate.
President Obama has repeatedly said that the American people do not care about legislative procedures, they just care that things are done. We shall soon see whether the president is right.
